Introduction
DermaDetect Ltd. (“DermaDetect”, “we”, “our”, or the “Company”) welcomes you (the “User” or “you”) to our website(s) at www.dermadetect.com and any additional websites owned and operated by DermaDetect (the “Site”) and to our downloadable mobile application (the “App” and/or “Application”) and related services (collectively referred to as the “Service”, as further detailed below).
By entering, connecting to, accessing or using the Service, you acknowledge that you have read and understood the following terms and conditions, including the terms of our Privacy Policy (collectively, the “Terms”) and you agree to be bound by them and to comply with all applicable laws and regulations regarding your use of the Service and you acknowledge that these Terms constitute a binding and enforceable legal contract between DermaDetect and you. These Terms of Service are a legally binding contract between you and DermaDetect regarding your use of the Service.
In order to provide users a safe, respectful, professional experience while using the application we have developed a detailed Terms of Use.
Use of the application means that you agree to abide by the Terms of Use as they are formulated herewith as well as to the Privacy Policy.
In order to provide a safe, secure and private environment for our users these Terms of Use are strictly enforced.  DermaDetect has the right to monitor information in order to safeguard these Terms of Use.
We have the right to change or update the Terms of Use and Privacy Policy as required,
(including, without limitation, the fees and payment terms for the Products and Services), simply by posting such change to these Terms of Use and/or at our Site/App.
 Please review the Terms of Use and Privacy Policy regularly to ensure you have accessed the latest version. By using the application and the service you acknowledge that you have read, understood and agree to the Terms of Use and Privacy Policy.
Users agree not to use any content which is abusive, offensive, defamatory, harming, offensive, pornographic/sexual or any information they know to be untrue, or that violates any laws.
We reserve the right to terminate the account of any member who abuses the site/breaches the rules.
Users are solely responsible for any and all content they provide via the application.
 Users
By using this site, you warrant that:

1. 1. Site is for an individual private use, Shall not be used for any business transactions
   2. All information (including but not limited to personal and medical data) you provide is truthful.
   3. You have not previously been removed from our Services by us, unless you have our express written permission to create a new account.

As a User You agree to:

• 1.Comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements.
  2.Be respectful when communicating on the application.
  3.Take reasonable measures to protect the security of your login information.

As a Member You agree that you will not:

• 1.Misrepresent your personal or medical information;
  2.Use the Services in a way that damages the Services or prevents their use by other users;
  3.Use our Services in a way to interfere with, disrupt or negatively affect the platform, the servers, or our Services’ networks;
  4.Use our Services for any harmful, illegal, or nefarious purpose;
  Harass, bully, stalk, intimidate, assault, defame, harm or otherwise mistreat any person;
  5.Post or share Prohibited Content;
  6.Solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other users or disseminate another person’s personal information without his or her permission;
  7.Use another user’s account;
  8.Disclose private or proprietary information that you do not have the right to disclose;
  9.Copy, modify, transmit, distribute, or create any derivative works from, any Member Content or Our Content, or any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information accessible through our Services without DermaDetect's prior written consent;
  10.Use any robot, crawler, site search/retrieval application, proxy or other manual or automatic device, method or process to access, retrieve, index, “data mine,” or in any way reproduce or circumvent the navigational structure or presentation of our Services or its contents;
  11.Upload viruses or other malicious code or otherwise compromise the security of our Services;
  12.“Frame” or “mirror” any part of our Services without prior written authorization;
  Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of our Services, or cause others to do so;
  13.Use or develop any third-party applications that interact with our Services or Member Content or information without our written consent;
  14.Use, access, or publish the DermaDetect application programming interface without our written consent;

Prohibited Content

• Any content which is not directly related to the medical condition for which you are seeking advise;
  Is likely to be deemed offensive or to harass, upset, embarrass, alarm or annoy any other person;
  Is obscene, pornographic, violent or otherwise may offend human dignity, or contains nudity;
  Is abusive, insulting or threatening, discriminatory or that promotes or encourages racism, sexism, hatred or bigotry;
  Encourages or facilitates any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offense;
  Is defamatory, libelous, or untrue;
  Relates to commercial activities (including, without limitation, sales, , and advertising or solicitation for services,
  Involves the transmission of “junk” mail or “spam”;
  Contains any spyware, adware, viruses, corrupt files, worm programs or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Match or otherwise;
  Infringes upon any third party’s rights (including, without limitation, intellectual property rights and privacy rights);
  Is inconsistent with the intended use of the Services; or

You understand that:

• You are solely responsible for the information you provide on the application.
  DermaDetect takes maximum precautions to ensure the service is available without interruption. However, by using the application you understand that our service is based on 3rd parties (such as internet networks) for which we are not responsible. DermaDetect will not be held liable for the provision of services of any 3rd parties.
  Use of the service is enabled via the internet, and that the service is therefore subject to the general risks involved with using the internet, (Such as, but not limited to viruses)
  Information that you provide is personal and does not represent any other person.
  You agree to hold us harmless from any claims made in connection with your content.
  DermaDetect has the right to monitor your content and remove any content, messages, photos, videos, audio, profiles, registration that is deemed inappropriate.
  DermaDetect has the right to ban you from using the service if you do not abide by these terms. DermaDetect has the right to investigate and take appropriate legal action at its sole discretion against anyone who violates this provision including without limitation removing the offending communication from the Service and terminating the usage of such violators.
  DermaDetect owns all content/images/icons/graphics displayed on the application and that you are not entitled to use, modify, share, copy without appropriate authorization.
  DermaDetect has the right to monitor and review all content shared by its users in order to ensure proper use of Site.
  The Application is not to be used in the case of an emergency. The Application does not replace urgent care/emergency care.
  The accuracy of the diagnosis depends on the quality and detail of the information you provide and the ability of the Dermatologist to provide diagnosis. Please be as detailed and precise as possible in describing the affected area/your case. It is important that you take clear and in-focus photos of the affected area. If you are not able to take clear photos of the area on your own, please have another party take photos on your behalf. If the Dermatologist cannot give a diagnosis based on the information and the photos, the payment will be refunded.
  All cases are reviewed by a certified Medical Doctor in Dermatology.
  Your case will be reviewed and a response will be provided within time specified on your chosen payment option (120/48/24 hours) however, DermaDetect saves the option for 24 hours delay on each chosen option indicated above.
  You have the right to delete all the information pertaining to a specific case you opened.
  You have the right, at any time, to delete all your personal information. However, be advised that once you open another case you may be required to provide this information again in order for us to provide Service.
  The Service is not intended for minors under the age of 18 without supervision and consent by a parent or guardian.
  The diagnosis, treatment plan and prescriptions will be provided within the App under "Summary and Diagnosis" screen.  The user will receive a notification to the App once a diagnosis was received.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DERMADETECT, ITS AFFILIATES, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES, (II) THE CONDUCT OR CONTENT OF OTHER USERS OR THIRD PARTIES ON, THROUGH, OR FOLLOWING USE OF THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT, EVEN IF DERMADETECT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL DERMADETECT’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT PAID, IF ANY, BY YOU TO DERMADETECT FOR THE SERVICES WHILE YOU HAVE AN ACCOUNT.
THE LIMITATION OF LIABILITY PROVISIONS SET FORTH IN THIS SECTION 14 SHALL APPLY EVEN IF YOUR REMEDIES UNDER THIS AGREEMENT FAIL WITH RESPECT TO THEIR ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
 
 General
These Terms do not, and shall not be construed to create any partnership, joint venture, employer- employee, agency, or franchisor-franchisee relationship between the parties hereto. Any claim relating to the Service or use of the Service will be governed by and interpreted in accordance with the laws of the State of Israel, without reference to its conflict-of-laws principles. Any dispute arising out of or related to your use of this Site and/or the Service will be brought in, and you hereby consent to exclusive jurisdiction and venue in, the competent courts of the District of Tel Aviv, Israel. If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provision. You may not assign, sublicense or otherwise transfer any or all of your rights or obligations under these Terms without DermaDetect’s prior express written consent. No waiver by either party of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default. Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof. These Terms are the entire terms and conditions between you and DermaDetect relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements or understandings between you and DermaDetect. Notices to you may be made via email or regular mail. Our Service may also provide notices of changes to these Terms or other matters, by displaying such notices or by providing links to such notices. Without limitation, you agree that a printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
